EU regulation 2023/1442 has just amended EU regulation 10/2011 on plastic materials and articles intended to come into contact with foodstuffs.

It modifies the SMLs (Specific Migration Limits) for the following 5 phthalates:

  • DBP (Dibutyl phthalate)
  • BBP (Benzyl butyl phthalate)
  • DEHP (Bis(2-ethylhexyl) phthalate)
  • DINP (Diisononylphthalat)
  • DIDP (Di-isodecyl phthalate)

DBP and DEHP can be used as plasticizers in reusable materials and objects in contact with non-fatty foodstuffs.

BBP, DiNP and DiDP may be used as plasticizers in reusable materials and articles and as plasticizers in single-use materials and articles in contact with non-fatty foodstuffs, with the exception of infant formula and follow-on formula.

The SMLs of these 5 phthalates were reduced.

DBP SML increased from 0.3 mg/kg to 0.12 mg/kg.

The SML for DEHP is reduced from 1.5 mg/kg to 0.6 mg/kg.

BBP's SML is reduced from 30 mg/kg to 6 mg/kg.

The SML for the sum of DiNP and DiDP rises from 9 mg/kg to 1.8 mg/kg.

Plastic materials and articles complying with the provisions of regulation (EU) no. 10/2011 applicable before 01/08/23, and placed on the market for the first time before 01/02/2025, may remain on the market until stocks are exhausted.

The regulations come into force on August 1, 2023.
